J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm intends to pay for different types of cancer victims as part of bankruptcy settlement. J&J is seeking another time to settle more than 38,000 lawsuits in bankruptcy and prevent new cases from arising in the future.
LTL’s bankruptcy plan will pay $400 million to a separate trust for claims made by state attorneys general alleging that J&J was in violation of state unfair business practices and consumer protection laws by misleading consumers regarding the security of its talc-based products.

Johnson & Johnson asserts that bankruptcy is the only method to settle both present and future talc litigations in a definitive manner. Attorneys representing cancer patients who are against the agreement argue this with what you conclude is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier ruling. The hyperbole wasn’t spared: victims’ lawyers call it the largest “fraudulent move that has occurred in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. But it is a way to try and push the $8.9 billion settlement, and to keep pressure on plaintiffs.

Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) concerning talc products in exchange in exchange for a portion of settlements. J&J is now willing an offer of $8.9 billion to settle any lawsuits.
The funders’ involvement is public information due to an New Jersey court rule requiring the disclosure of certain information regarding outside funding backers.
