The essence in this 3rd Circuit decision was this is not a case of one that makes a profit, but an entity to assume the legal liability and declare bankruptcy – Congress thought of when drafting its Bankruptcy Code. However, it also stated that the entity was in financial difficulty due to the fact that J&J assured it of unlimited funding.
So J&J jumped on the unlimited funding aspect of the contract but did not pledge to offer unlimited funding for cases. The company says that its new financing agreements with its subsidiary address the concerns of the appellate court, while offering funds to pay claims. As if offering victims less money would solve the overarching problem.
Attorneys representing cancer victims who oppose the deal counter the agreement with what is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier decision. The hyperbole wasn’t spared: victims’ lawyers call it the largest “fraudulent transfer in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe that this bankruptcy will last. It is however a method of trying to push this $8.9 billion settlement to keep the pressure on plaintiffs.
April 10, 2023 Update: Bloomberg offers an informative article about a new law within New Jersey that is shedding new light on litigation funding in the plaintiffs in the class action. J&J has now offered to pay $8.9 billion to settle all lawsuits.
The involvement of the funders is publicly available because of the New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rules aim to address the rising calls for regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you add up state and federal child powder-related lawsuits. Third-party funding in mass tort claims has both pros and pros and. There is no doubt that we are witnessing how third-party funding can level the playing field between individual and big companies in court.
