J&J’s proposed talc settlement would make payments of $400 million to US state AGs. Talc Asbestos Ovarian Cancer .

Johnson & Johnson (JNJ.N) has put aside $400 million to resolve U.S. state consumer protection actions as part of a wider $8.9 billion deal to settle allegations that its Baby Powder and other talc-based product causes cancer. Talc asbestos ovarian cancer.

J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday which outlines how the company will pay various types of cancer victims as part of bankruptcy settlement. Talc asbestos ovarian cancer. J&J has stated that its products containing talc are safe and do not cause cancer. The company is trying for another time to settle more than 38,000 lawsuits filed in bankruptcy and stop new cases from arising in the near future.
LTL’s bankruptcy plan would pay $400 million to a separate trust for claims made with state attorneys general alleging that J&J violated states’ unfair practices and consumer protection laws by misinforming consumers about the dangers of its talc products.

A number of states had already initiated consumer protection measures against J&J prior to LTL’s bankruptcy filing stopped those investigations from taking place in 2021. Talc asbestos ovarian cancer. New Mexico and Mississippi had already brought lawsuits against Johnson & Johnson before then and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative subpoenas or demands in LTL’s court filings.

New Mexico and Mississippi have decided to declare LTL’s bankruptcy unfinished along with cancer sufferers as well as their counterparts from the U.S. Justice Department’s bankruptcy watchdog, who have argued that a successful business like J&J cannot benefit from bankruptcy protections designed for those struggling with debt.
The first attempt by LTL to resolve the bankruptcy cases was dismissed after similar arguments, when a U.S. appellate court determined in favor of LTL had not been in “financial financial distress” and therefore not eligible under bankruptcy law. Talc asbestos ovarian cancer. LTL made a new bankruptcy application within two hours of that dismissal, arguing that its second attempt was different because it was able to borrow less and had a greater chance of securing the settlement.

New Mexico and Mississippi said in their motion to dismiss LTL’s latest bankruptcy violation of the state’s law enforcement authority by seeking to unilaterally limit LTL’s liability to state consumer protection laws.

The filings of LTL’s latest bankruptcy proceedings also include more information on the way in which the company will evaluate and pay cancer claims when the bankruptcy plan is approved.

The most significant payments under the settlement would be $500,000 for patients diagnosed with mesothelioma that is terminal before age 45. Talc asbestos ovarian cancer. The second payment would be $260,000 for people diagnosed with ovarian cancer that is terminal before age 45.

From there, the proposed settlement applies discounts depending on the type and severity of cancer, the individual’s age, history of talc use and other factors. Talc asbestos ovarian cancer. For instance the case of a woman who used talc products weekly, had an ancestral history of ovarian cancer, and was diagnosed with the stage 2 ovarian cancer by age 55 could be in line to receive a payment of $21,125 under the program.

Judge orders J&J, talc opponents to take part in settlement talks.

Following another round of hearings in Johnson & Johnson’s effort to use a Texas Two-Step bankruptcy strategy for talc litigation and federal bankruptcy judge Michael Kaplan has ordered the firm and the people who opposed the strategy to engage in talks to reach a settlement, Bloomberg reports.

With its second bankruptcy bid for LTL Management, a subsidiary set up by J&J to handle the claims company proposed a settlement of $8.9 billion. Talc asbestos ovarian cancer. While a group of law firms representing plaintiffs agree with the proposal, another group opposes the deal.

This week, the opposition group, dubbed”The Official Committee of Talc Claimants, urged the bankruptcy court to disqualify the petition by arguing that LTL can not be considered financially distressed.

“The filing is a desperate and legally ineffective attempt by a tiny number of law firms to prevent claimants from voting on the resolution, which that the overwhelming majority of claimants approve of,” J&J’s litigation chief Erik Haas, said in an announcement. Talc asbestos ovarian cancer. “The law firms who filed their filing are financially oriented and have conflicts that conflict with, diverge from and infringe on the rights of their clients. We’ll submit an answer an appeal to the appellate court.”

Talc asbestos ovarian cancer. Clay Thompson, a lawyer for MRHFM which boasts more than mesothelioma clients who have filed lawsuits against J&J for bankruptcy, told the company’s second bankruptcy try failed.

“J&J issue press releases describing how fantastic its plan is, while requesting that details of the plan, such as what the individual sick individuals would receive,” Thompson said in the statement. “What do they have to conceal?”

Kaplan has instructed the sides to come up with another strategy for reorganization, under the oversight from two mediators.

As of February 2022 Kaplan affirmed the ability of J&J’s recourse to Chapter 11 to hasten a settlement that would release J&J from the hundreds of thousands of claims regarding its talcum products.

However, in the month of January, a federal appeals court overturned the ruling, ruling that the company was not able to be considered in “financial trouble.”

The J&J’s plan to make an appeal before the U.S. Supreme Court was dismissed in April, J&J applied for its first bankruptcy roughly two hours later. In response to that move, Kaplan froze the lawsuits for 60 days to decide whether or not to approve an additional bankruptcy.

J&J’s unstoppable profit engine sputters after $6.9B cost of litigation involving talc.

With the two Chapter 11 attempts, J&J has bought 19 months during which cases have been held. Talc asbestos ovarian cancer. The company is requesting that claimants decide whether they want to accept the settlement. J&J would need 75% acceptance in order for the agreement to be accepted.

In addition to the gang of talc attorneys who have panned LTL’s bankruptcy plan and the U.S. Trustee is an arm of the U.S. Department of Justice is also submitting motions to dismiss the second bankruptcy case of LTL.

In a statement this week, U.S. trustee Andrew R. Vara wrote that the bankruptcy are “open to honest, but naive debtors.” Those doors “are not accessible to those that don’t have a legitimate bankruptcy purpose or that seek to use bankruptcy to hinder or delay their creditors,” Vara continued.

To its credit, J&J maintains there is no proof conclusive that their Talc-based products, such as its famous baby powder, cause cancer. J&J has adopted the products of the market–first in North America in 2020–and the rest of the world this year.

J&J seeks to avoid the expense of going to trial. J&J has won the majority of the cases that were decided in court, however some losses have been very severe.
A highly publicized trial in Missouri ended in a $4.7 billion verdict against the drug company that was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
Overall, J&J has lost nine cases involving talc, which are being appealed or settled. Of the 41 trials, 32 ended with winning for J&J or a mistrial, or verdict for a plaintiff that was annulled after appeal. Talc asbestos ovarian cancer. Additionally, the company has announced plans to settle nearly 1000 cases at a cost of $100 million, Bloomberg reported at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Talc Asbestos Ovarian Cancer

June 2 2023 Update: In the asbestos talc trial which took place in California yesterday, technical issues interrupted the opening speech of defense lawyers. Talc asbestos ovarian cancer. Jurors watching at home via Zoom but did not hear Johnson &Johnson’s lawyer express doubt about the 70s research affirming the presence of asbestos in their product, but the opening was abruptly ended.

Meanwhile, the plaintiff could introduce their first witness, Arthur Langer. Langer said that the presence of other minerals in the talc’s mineral content is inevitable. He said that his team had notified J&J in 1971 about the presence of chrysotile asbestos in the talc of the company, but at lesser than 0.1 percent. He also uncovered more asbestos in the year 1976.

June 1st, 2023 Update Talc asbestos ovarian cancer. First trial after J&J took the decision to disband its talc division, and then declare bankrupt is a pivotal moment in the ongoing talc litigation saga. Trial began yesterday in the poignant case of a young, 24-year-old plaintiff, diagnosed with an aggressive and rare form of mesothelioma earlier this year. a diagnosis lawyers on both sides acknowledge is a grave tragedy.

Opening statements revealed the stark differences in each side’s story. The attorney representing the plaintiff aimed his ire on Johnson & Johnson, alleging that the company employed deceitful methods in their research practices as well as throughout the litigation procedure. In the words of attorney, Johnson & Johnson attempted to alter the definition of asbestos in spite of internal documents dating from 1978 and 1994 showing that asbestos fibers in the tissue of the plaintiff are included.

Johnson &J’s tangled $8.9 billion settlement offer hangs in the balance with the course of this trial. Despite the particularity of this mesothelioma lawsuit and the unique issues it faces compared to other talcum powder lawsuits, a verdict favoring the plaintiff could inflict an enormous setback for J&J’s hopes for broad acceptance of their proposed settlement with plaintiffs.

May 31st 2023 Update: Johnson and Johnson’s bankrupt talc division vigorously defended it’s second Chapter 11 filing in the face of challenges from injured talc claimants. In an appeal to the New Jersey bankruptcy court, the subsidiary argued that the filing differed fundamentally from the first filing. It also emphasized the unprecedented commitment to $8.9 billion from J&J, the largest settlement ever in the history of a mass tort bankruptcy. Talc asbestos ovarian cancer. There was no mention of how the magnitude of the settlement implies that it is an equitable settlement. J&J also claimed support from a variety of plaintiffs’ law companies representing over 60,000 claimants. It is difficult to confirm but is probably incorrect.

May 24 2023 Update: In the wake of Johnson & Johnson’s bankruptcy in 2021 filing, the first trial involving its cosmetic talc products that are believed to that contain asbestos is scheduled to begin jury selection on Monday, May 24, California within the Alameda County Superior Court, which is a well-known location for plaintiffs. Plaintiff claims that mesothelioma resulted from asbestos exposure through J&J’s products which that the company is denying. The trial also includes six retailers who are accused of selling talc-containing products.

May 22, 2023 Update: Lawyers involved in the second J&J talc bankruptcy are battling over who should be appointed to the role of a the claims representative in the future, a role that is critically critical to resolving talc claims. Talc asbestos ovarian cancer. Randi Ellis, a lawyer who is frequently involved in MDLs throughout the country was appointed the claims representative during the first bankruptcy. J&J’s defense attorneys want Ellis to be named to the position yet again, but the lawyers for the talc plaintiffs are objecting on the grounds that Ellis has an interest conflict which would prohibit her from holding that position once more. The issue stems from the possibility that Ellis was involved in the creation of the hotly contesting second bankruptcy, which raises questions about her ability to be neutral. The reality is this bankruptcy is likely to be dismissed regardless.

May 17th, 2023 Update: The pretend company J&J put together for the talc litigation bankruptcy has informed an New Jersey bankruptcy court that they have designated $400 million as a settlement for claims of states that accuse the company of deceptive advertising for its talc products. Talc asbestos ovarian cancer. So that makes it an $8.5 billion settlement for cancer sufferers. It’s difficult to imagine any scenario in which J&J can push these baby powder settlements through given these numbers. Although J&J’s $8.5 billion offer sounds like a large sum initially, it may not look very appealing after you calculate the figures. The proposed settlement based on our rough calculations would not be able to pay victims more than an average settlement $100,000 per case. That’s not enough.

May 15, 2023 Update: J&J may be in the middle of a lawsuit by an advocacy group representing cancer victims. Talc asbestos ovarian cancer. The group claims J&J intentionally withdrew an $61.5 billion fund-raising agreement together with its parent company, LTL Management LLC, to simulate financial stress and to validate the company’s Chapter 11 bankruptcy filing. The group claims that this move amounts to a fraudulent transfer of the rights of victims’ compensation. They will investigate J&J’s actions following of the decision to dismiss the LTL’s bankruptcy case in its first instance.

May 10 2023 Update: Next week this week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to dismiss the second bankruptcy petition filed by J&J subsidiary LTL Management. However, in the meantime, LTL Management has filed an order requiring both sides to take part in a settlement mediation in the hope that an international settlement agreement can be reached.

May 5, 2023: Update on Talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer from asbestos exposure. Talc asbestos ovarian cancer. More than 2700 people have filed lawsuits against the company and it has been spending $1 million a month on legal defense. The company’s recent $29 million verdict on the state of South Carolina forced it to apply for bankruptcy protection and argue for an equitable distribution of assets among talc claimants instead of being seized through the receiver. Other suppliers of talc have been forced to file for bankruptcy as a result of lawsuits.

May 4 2023 Update: U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to restart talks on settlement with lawyers who turned down the company’s proposed $8.9 billion agreement. In Trenton, New Jersey yesterday the parties appeared in court to discuss next steps to take in another bankruptcy proceeding and Judge Kaplan was pushing for more settlement discussions.

This is the best way to resolve the claims of J&J. A baby powder settlement could be made. Talc asbestos ovarian cancer. But it’ll need more money – billions of dollars – of Johnson & Johnson.

Lawyers have a split opinion on whether or not to accept the plan and not all clients see the issue the same way their lawyer sees it. This second case of bankruptcy is destined to fail, the judge Kaplan has set a date for a hearing in June to determine if she will close the case for the third time.

May 3 2023 Update: A group representing cancer victims suing Johnson & Johnson (J&J) demanded an order from they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is a bid to stop litigation regarding talc-related products. The group of talc claimants submitted a motion on Tuesday, asking the Third Circuit to consider their appeal and return the case an earlier court with instructions to discharge the bankruptcy. Talc asbestos ovarian cancer. They also asked that lawsuit against the halted torts of J&J allow the litigation to continue.
LTL has filed for Chapter 11 protection once again following its bankruptcy filing that was rejected in the Third Circuit earlier this year which offered an $8.9 billion settlement. The committee argues that the recent ruling, which allows LTL’s 2nd Chapter 11 to continue, in addition to halting trials against J&J is a reason for the immediate Third Circuit review. The US Trustee has also requested an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a statement in the appeals court, characterizing the filing as a “desperate and legally inadequate move” by a handful of law firms with competing financial interests.
May 1 2023 Update: One frequently asked question is how the plaintiffs’ lawyers and their clients turn around $8.9 billion. That’s of course an enormous amount of money. But there are plenty of victims. Talc asbestos ovarian cancer. These are an excellent claims for plaintiffs. We were reminded recently in two talc trials which have resulted in huge verdicts for the plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon led to the verdict of $18.1 million. The following month, a second mesothelioma trial involving talc was held for the court within South Carolina and resulted in an award of $29 million to the plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. One of the largest suppliers of talc within the U.S.
April 30th 2023 Update: When J&J initially tried to take the talcum powder lawsuit into bankruptcy, it came with an offer to set aside $2 billion to settle the case. The amount was absurdly low. All of the talc plaintiffs agreed with it. This time, however, J&J has increased the offer to $8.9 for talc-related plaintiffs if they will allow a bankruptcy settlement and also has the backing of a significant part of the talc-related plaintiffs and their lawyers. Talc asbestos ovarian cancer. But 75% of the plaintiffs in the talc category, which is required for bankruptcy plan approval, it a tough road due to the sheer number of lawyers with huge inventories of baby powder litigations opposed towards the agreement.

What are the solutions to the impasse? More billions.
April 25 2023 Update Talc cancer claimants have sought a court order to disqualify the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, insisting that the company is not financially distressed. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Talc asbestos ovarian cancer. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company was not eligible to receive bankruptcy relief because it did not show financial difficulties.

The claimants argue that LTL’s Second Chapter 11 case is an fraud on the bankruptcy system and that it’s being pursued in bad faith. J&J claims the bankruptcy settlement is backed by “significant backing” from companies representing around 60,000 people who are claiming. It is fair to say that the plaintiffs’ attorneys and victims ‘ lawyers are not united over their disagreement over the $8.9 billion settlement offer.

April 21, 2023 Update: A bankruptcy judge has decided the company Johnson & Johnson must face new lawsuits alleging that the company offered a baby powder with a contaminant that caused cancer. While trials in Talc lawsuits are suspended for at least 60 calendar days and new lawsuits are able to be filed, and lawyers can begin preparing their cases. Talc asbestos ovarian cancer. The judge expressed skepticism over J&J’s ridiculous effort to revive its strategy by filing another bankruptcy case.

April 13th 2023 update: the biggest story is that there’s an $8.9 billion over 25 years offer for settlement. Lawyers representing cancer victims within MDL class action MDL Class Action have vowed to fight the settlement alongside the talc claimants. Why? They argue that it’s not enough for more than 70,000 cancer victims. Talc asbestos ovarian cancer. The lawyers say that J&J should negotiate a bigger settlement or litigate individuals’ claims if the current bankruptcy is declared unconstitutional.

However, there is a second group of lawyers outside of the top leadership in that class action. These lawyers have collectively amassed many thousands of cases. The group is seeking to settle the case now with what they believe is less than these victims deserve. Their argument is twofold. First, they argue the settlement – which amounts to the equivalent of $100,000 per plaintiff is fair.

This is an argument that is difficult to prove. The second argument is more substance: the victims will not afford to wait any longer and need their money today.

April 12, 2023 Update: People are looking for ways J&J can file for bankruptcy once more. The answer is complicated and confusing. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future lawsuits involving talc conclusively. Also, it believes that it will be less expensive if there is a bankruptcy component that applies pressure for a settlement. Talc asbestos ovarian cancer. Driving past the 400-year span of American history, the firm claims that bankruptcy benefits everyone by dispersing settlements more fairly and more efficiently than trial courts which are where litigants get significant payouts, while others are left with nothing.

The basic tenet in this 3rd Circuit decision was this isn’t a case that involves an enterprise that is profitable, forming an affiliate to accept the legal responsibility and declare bankruptcy, which is what Congress thought of when drafting its Bankruptcy Code. However, it also stated that the subsidiary was not in financial difficulty because J&J assured it of unlimited funding.
So J&J took advantage of the funding unlimited part of the deal and didn’t promise to offer unlimited funding for lawsuits. The company claims that revised financing arrangements with its subsidiary address the concerns of the appeals court while providing funds for claims. As if offering victims lesser money could solve the underlying issue.

Lawyers representing cancer victims who oppose the agreement counter this argument by saying that it is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole was not spared attorneys representing the victims claim this the biggest “fraudulent move in United States history.”

Despite all the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way of pushing this $8.9 billion settlement and keep pressure on plaintiffs.

April 10 2023 Update Bloomberg has an interesting piece on a law that has been passed within New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) regarding talc products, in exchange for a share of any settlements. J&J is now willing that it will pay $8.9 billion in settlements for all lawsuits.

The funders’ involvement is public information due to an New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rules aim to tackle the growing demands for the regulation of litigation funders. J&J has more than 60,000 claims when you add up state and federal baby powder lawsuits. Third-party funding of mass tort cases has both pros and cons. But there is no question that we are witnessing the ways that third-party funding can even the playing field for individuals and large corporations in court.

April 4, 2023 Update: It is enjoyable to see the worm turning in this lawsuit. J&J suffered another setback this week when an appeals court in the Third Circuit denied J&J’s request to maintain the automatic stay in the meantime that J&J appeals a bankruptcy ruling before the U.S. Supreme Court. The automatic stay has frozen hundreds of cases involving talcum powder and stopped any the filing of new lawsuits ever since J&J launched the controversial attempt to spin the talc debts into a bankrupt entity over one year ago. Talc asbestos ovarian cancer. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient just a few months ago the stay was revoked. J&J had hoped to have it remain in effect until its SCOTUS appeal. The answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that is that the Supreme Court is willing even to take up the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay officially lifted, the very first new cases were filed and incorporated into the class action for talcum powder MDL in just over a year. Seven new talc lawsuits were joined to the MDL over the last month which brings the total number of cases pending to 37,522.

February 25, 2023 Update The following information is available: A Congressmen from Tennessee has now demanded that The U.S. Government Accountability Office (GAO) start an investigation into the cost J&J product containing talc has cost the government over the decades.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the dangers of its talc products over many years, while tax dollars were utilized to treat people injured by exposure to the chemicals. The lawsuit comes just a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Talc asbestos ovarian cancer. J&J has to begin making reasonable settlement proposals to victims to begin in putting this behind it. This is a disgrace to one of the most prestigious firms.

February 14 2023 Update: During an appearance today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
