Talc in soap safe. But 75% of the plaintiffs in the talc category, which is required for bankruptcy plan approval is not an easy task due to the sheer number of lawyers with massive inventories of baby powder lawsuits that are opposed in favor of the deal.
What can be done to end the impasse? More billions.
April 25, 2023 update: Talc plaintiffs have sought a court order to dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Talc in soap safe. The 3rd Circuit dismissed its first Chapter 11 case in January and said that LTL was not eligible for bankruptcy relief as it had not demonstrated financial difficulties.
The claimants contend that the Second Chapter 11 case is an fraud on the bankruptcy system and that it is being pursued in bad good faith. J&J claims the bankruptcy settlement receives “significant support” from firms representing an estimated 60,000 people who are claiming. It is fair to say that plaintiffs’ lawyers and victims ‘ lawyers are not united over what they believe is an $8.9 billion settlement offer.
April 21st, 2023 Update A bankruptcy judge ruled in favor of Johnson & Johnson must face new lawsuits alleging that the firm sold baby powder that was contaminated and causing cancer. Judges expressed skepticism about J&J’s ridiculous effort to relaunch its strategy in the second bankruptcy case.
April 13, 2023 Update: The most important news is the $8.9 billion over 25 years of settlement. Lawyers representing cancer patients who are part of the MDL class action have vowed to fight the settlement alongside the talc claimants. Why? They think it is not enough money for those suffering from cancer who are 70,000. Talc in soap safe. These lawyers believe that J&J should negotiate a bigger settlement or pursue individual claims if the latest bankruptcy is dismissed.
However, there is a second group of lawyers that is not part of the leadership in this class action. They have amassed hundreds of thousands of cases. This group wants to settle the case now with what they believe is less than the victims deserve. The argument they make is two-fold. First, they argue that the settlement, which is about 100 million dollars on average per plaintiff – is fair.
This argument isn’t easy to present. But their second argument has more teeth: victims can now not wait and they want their money today.
April 12 2023 Update: People are asking how J&J can file for bankruptcy once more. The answer is complex and complex. Let’s try to simplify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future lawsuits involving talc conclusively. That is, it thinks it will pay less should there be the bankruptcy element which applies pressure to negotiate a settlement. Talc in soap safe. In a quest to cover hundreds of years of American time, the business asserts that bankruptcy benefits all parties by distributing settlement payments more evenly and efficiently than trial courts, where litigants are awarded significant settlements while others get nothing.
The basic tenet of this 3rd Circuit decision was this is not a matter of a profitable company making subsidiaries to meet the legal responsibility and declare bankruptcy Congress had in mind when it came to drafting the Bankruptcy Code. It also clarified that the subsidiary was not in financial difficulty because J&J assured it of unlimited funding.
So J&J took advantage of the funding unlimited part of the agreement and didn’t make any promises to fund unlimited cases. The company claims that its revised financing arrangements with its subsidiary address concerns of the appeals court while providing funds for claims. In the hope that offering victims lesser money could solve the overarching problem.
Lawyers representing cancer patients who oppose the agreement counter this with what you conclude is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole did not go unnoticed by the victims’ lawyers, who call this the biggest “fraudulent transaction in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think that the bankruptcy will endure. However, it’s a means to try and push the $8.9 billion settlement, and to keep pressure on plaintiffs.
April 10, 2023 update: Bloomberg is running an intriguing piece on a law that has been passed within New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) over talc products in exchange for a percentage of any winnings. J&J is now willing that it will pay $8.9 billion in settlements for all lawsuits.
The funders’ involvement is made public because of an New Jersey court rule requiring the release of certain details regarding outside funding backers. This rule is intended to respond to the increasing calls for the regulation of lawsuit funders. J&J has to deal with more than 60,000 lawsuits when you include state and federal infant powder litigation. Third-party funding in mass tort claims has its pros and pros and. There is no doubt that we are seeing how third-party funding can level the playing field between individual and large corporations in court.
April 4 2023 Update: It’s interesting to watch the worm turn in this lawsuit. J&J suffered another setback this week, when they were denied by the Third Circuit denied J&J’s request to keep the automatic stay in place in the meantime that J&J appeals an appeal to the U.S. Supreme Court. Automatic stays have halted thousands of talcum cases and prevented new lawsuits from arising ever since J&J began the controversial plan to spin the talc debts into a bankrupt entity over one year in the past. Talc in soap safe. After the 3rd Circuit ruled that this bankruptcy was not valid just a few months ago the stay was removed. J&J was hoping to have it stayed in place until hearing the SCOTUS appeal. The answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that the Supreme Court is willing even to consider the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay fully lifted, the first new cases have been filed and transferred into the Talcum Powder class action MDL in the space of a year. Seven new talc-related lawsuits were added to the MDL during the month of March which brings the total number of cases that are pending to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee has now demanded that the U.S. Government Accountability Office (GAO) initiate an investigation into the cost J&J product containing talc has cost the government over the decades.
in a letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the risks of its talc products for years while tax dollars were used to treat those who were injured through exposure to the products. The demand comes just weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
Talc in soap safe. J&J needs to start making reasonable settlements to victims to to put all of this behind. This is a disgrace to one of the world’s greatest companies.
