April 25 2023 Update Talc plaintiffs have requested a judge to dismiss their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, saying the company is not financially distressed. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Talc in vitamin c is safe. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that LTL was not eligible for bankruptcy relief because it did not show financial trouble.
The claimants argue that LTL’s 2nd Chapter 11 case is an abuse of the bankruptcy system, and that it’s being conducted in bad faith. J&J states that the bankruptcy settlement receives “significant backing” from companies representing about 60,000 potential claimants. It is fair to say that lawyers representing plaintiffs and victims ‘ lawyers are not united over the $8.9 billion offer for settlement.
April 21, 2023 Update: A bankruptcy judge ruled that Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. Although the trials for talc lawsuits are paused for at least 60 days, new lawsuits can be filed, and lawyers can begin preparing their cases. Talc in vitamin c is safe. April 13th 2023: Update on the big announcement is an $8.9 billion over 25 years settlement offer. Lawyers representing cancer patients within the MDL class action have pledged to fight the settlement with Talc claimants. Why? They feel it’s not enough for those suffering from cancer who are 70,000. Talc in vitamin c is safe. These lawyers argue that J&J could negotiate a greater settlement or even litigate individual claims if the latest bankruptcy is declared unconstitutional.
But there’s a separate set of lawyers who are not part of the leadership of group action. They have amassed tens of thousands of cases. This group wants to settle the case now in what many believe to be less than the victims deserve. The argument they make is twofold. First, they argue the settlement – which amounts to an average of $100,000 per plaintiff – is fair.
That is a hard argument to argue. The second argument is more teeth: victims can be no longer patient and demand their money today.
April 12, 2023 Update: People are asking how J&J could file for bankruptcy once more. The answer is complex and convoluted. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc-related lawsuits definitively. In other words, it thinks it will pay less in the event of a bankruptcy element that creates pressure to settle. Talc in vitamin c is safe. Going back to more than 400 years in American time, the business claims that bankruptcy benefits everyone by dispersing settlement payments more evenly and effectively than trial courts, where some litigants receive significant award while others do not.
The main thrust in the 3rd Circuit decision was this is not a case – an enterprise that is profitable, forming subsidiaries to meet the legal liability and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code. However, it also stated that the entity was in financial distress due to the fact that J&J assured it of unlimited funding.
So J&J decided to go with the unlimited funding portion of the agreement but did not pledge to provide unlimited funding for the litigation. The company says that its modified financing arrangements with its subsidiary addresses the appeals court’s concerns, while providing funds for claims. As if providing victims with lower amounts of money would resolve the overarching problem.
Attorneys representing cancer victims who do not agree with the agreement counter the agreement with what is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s ruling. The hyperbole wasn’t spared: victims’ lawyers call it the most significant “fraudulent deal that has occurred in United States history.”
In spite of the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it’s a way of trying to push this $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10 2023 update: Bloomberg has an interesting article on a new law in New Jersey that is shedding new light on litigation funding in the class action lawsuit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) regarding talc products, in exchange for a share of any profits. J&J is now offering an offer of $8.9 billion to settle any lawsuits.
The involvement of the funders is made public because of a New Jersey court rule requiring the disclosure of certain information about funding sources outside of the. This rule is intended to tackle the growing demands for the regulation of litigation funders. J&J is facing more than 60,000 claims when you add up state and federal Baby Powder lawsuits. Third-party financing in mass tort cases is not without its pros and cons. But there is no question that we are seeing how third-party funding can level the playing field between people and big companies in court.
April 4 2023 Update: It’s fun to watch the worm turning in this case. J&J has taken another blow this week, when an appeals court in the Third Circuit denied J&J’s request to extend the automatic stay while J&J appeals a bankruptcy ruling at the U.S. Supreme Court. The automatic stay has froze thousands of talcum powder cases and prevented new lawsuits from being filed ever since J&J began the controversial plan to spin the talc liability off into a bankrupt company over a year ago. Talc in vitamin c is safe. When the 3rd Circuit ruled that this bankruptcy was not valid only a few months back, the stay was lifted. J&J wanted to see it remain in effect until an appeal to the SCOTUS appeal. But, no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance for the Supreme Court is willing even to take up the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay having been officially lifted, the first new cases have been filed and transferred into the Talcum Powder class action MDL in just over a year. Seven new talc-related lawsuits were added to the MDL in the past month, bringing the total number of cases that are pending to 37,522.
February 25, 2023 Update 2023 Update: A Congressmen from Tennessee is now requesting that the U.S. Government Accountability Office (GAO) initiate an investigation into the cost J&J talc products have cost the government in the years.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc product for long while tax dollars spent on treating people who suffered injuries from exposure to the product. This lawsuit comes a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
Talc in vitamin c is safe. J&J must begin making fair settlement offers to victims to begin to put all of this behind it. It is a stain on one of the most prestigious companies.
