Johnson & Johnson (JNJ.N) has put aside $400 million to resolve U.S. state consumer protection actions as part of its broad $8.9 billion plan to settle allegations that it’s Baby Powder and other talc-based products cause cancer. Talc is it safe.

J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company plans to pay different kinds of cancer victims as part of the bankruptcy settlement. April 12 2023 Update: Many are wondering if J&J can file for bankruptcy again. The answer is complex and convoluted. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future lawsuits involving talc conclusively. It believes that it will be less expensive should there be a bankruptcy element that creates pressure to negotiate a settlement. In a quest to cover the 400-year span of American history, the company argues that bankruptcy benefits everyone by dispersing settlement payments more evenly and more efficiently than trial courts where litigants are awarded significant payouts, while others are left with nothing.

The basic tenet of the 3rd Circuit decision was this is not a case – an enterprise that is profitable, forming an affiliate to accept the legal risk and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. However, it also stated it was not financially difficulty due to the fact that J&J assured it of unlimited funding.
Then J&J did not hesitate to take advantage of the unlimited funding part of the holding and didn’t make any promises to provide unlimited funding for cases. The company says that its modified financing arrangements with its subsidiary address concerns of the appellate court, while offering claim payment funds. It’s as if giving victims lower amounts of money would resolve the overall issue.

Lawyers representing cancer victims who do not agree with the agreement counter this with what you conclude is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the biggest “fraudulent deal that has occurred in United States history.”
