J&J’s proposed talc settlement would provide 400 million dollars to US state AGs. Talc Is It Safe .

Johnson & Johnson (JNJ.N) has put aside $400 million to resolve U.S. state consumer protection actions as part of its broad $8.9 billion plan to settle allegations that it’s Baby Powder and other talc-based products cause cancer. Talc is it safe.

J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company plans to pay different kinds of cancer victims as part of the bankruptcy settlement. Talc is it safe. J&J has said that its Talc products are safe and will not cause cancer. It is attempting for a second time to resolve more than 38,000 lawsuits filed in bankruptcy, and to prevent any new cases from arising in the near future.
LTL’s bankruptcy plans would deposit $400 million into a separate trust for claims brought with state attorneys general alleging that J&J had violated laws against unfair business practices in the State of New York and consumer protection laws, by deceiving consumers regarding the safety of its talc products.

A number of states had already initiated consumer protection actions against J&J prior to the first bankruptcy filing prevented these investigations from progressing in 2021. Talc is it safe. New Mexico and Mississippi had already launched actions with Johnson & Johnson before then and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued subpoenas or civil investigative demands according to court filings.

New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy in a joint move with cancer victims as well as The U.S. Justice Department’s watchdog on bankruptcy, who have argued that a successful company like J&J does not qualify for bankruptcy protections designed for those struggling with debt.
The first time LTL attempted to settle the bankruptcy lawsuits was thrown out after similar arguments. A U.S. appellate court determined that LTL wasn’t in “financial difficulty” and therefore not eligible to receive bankruptcy relief. Talc is it safe. LTL made a new bankruptcy application less than two hours after the dismissal, saying that the second bankruptcy was different because there was less money available and more backing for a settlement.

New Mexico and Mississippi said in their motion for dismissal that LTL’s latest bankruptcy violation of state law enforcement authorities in attempting to unilaterally limit LTL’s liability to state consumer protection actions.

Talc Is It Safe

The filings of LTL’s latest bankruptcy proceedings also include more details on the way in which the company will evaluate and pay cancer claims when the bankruptcy plan is approved.

The highest payments under the settlement will be $500,000 for those diagnosed with mesothelioma that is terminal before age 45. Talc is it safe. The second payment would be $260,000 for patients diagnosed with terminal ovarian cancer before age 45.

From there, the proposed settlement applies discounts depending on the type and severity of cancer, an individual’s years of age, their history of the use of talc, and other aspects. Talc is it safe. For example an individual who was using talc products weekly, had an ovarian cancer family history, cancer and was diagnosed Stage II cancer of the ovary by age 55 may qualify for a $21,125 payment under the settlement plan.

Judge decides J&J and talc opponents engage in settlement talks.

Following another round of hearings in Johnson & Johnson’s attempt to employ a Texas Two Step bankruptcy strategy to resolve talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the company and those opposing the move to conduct negotiations to settle the matter, Bloomberg reports.

In its second bankruptcy effort for LTL management, a subsidiary founded by J&J to manage the claims company proposed a settlement of $8.9 billion. Talc is it safe. While one group of law firms representing plaintiffs supports the offer, another group is opposed to the offer.

Earlier this week, the opposition group, known as the Official Committee of Talc Claimants requested the bankruptcy court for dismissal of the matter saying that LTL can not be considered financially distressed.

“The filing is an unjust and legally flawed attempt by a tiny number of law firms to try to prevent claimants from voting on the resolution plan – a plan that the vast majority of claimants are in favor of,” J&J’s litigation chief Erik Haas, said in an announcement. Talc is it safe. “The law firms behind the filing are pursuing financial interests which are in conflict with, differ from and infringe on the rights of their clients. We’ll submit a response an appeal to the appellate court.”

Talc is it safe. Clay Thompson, a lawyer for MRHFM, which includes more than mesothelioma victims who have filed lawsuits against J&J, said that the second bankruptcy attempt of J&J will fail.

“J&J issues press releases that boast about how amazing its plan is while simultaneously insisting that the plan’s details, including what individuals with illnesses would be treated to,” Thompson said in the statement. “What is J&J’s plan to conceal?”

Kaplan has instructed the sides to come up with another reorganization plan, under the oversight of two mediators.

In February 2022, Kaplan confirmed J&J’s recourse to Chapter 11 to hasten a settlement that would relieve the company from the hundreds of thousands of claims related to its talcum-based products.

However, in the month of January, an appeals court in the United States overturned the decision, ruling that the company could not be considered to be in “financial financial distress.”

In the event that J&J’s request to contest the U.S. Supreme Court was denied on April 1, J&J declared bankruptcy just two hours after. In response, Kaplan froze the lawsuits for 60 days in order to determine whether to allow an additional bankruptcy.

J&J’s unstoppable profit engine sputters after $6.9B cost of litigation involving talc.

With the two Chapter 11 attempts, J&J has been able to buy 19 months in which cases were placed suspended. Talc is it safe. J&J wants the claimants to accept their settlement. J&J would need 75% approval for the deal to pass.

Alongside the group of talc lawyers who criticised the company’s bankruptcy, the U.S. Trustee which is a division belonging to the U.S. Department of Justice was also the one to file an application to dismiss the second bankruptcy case of LTL.

In a filing this week, U.S. trustee Andrew R. Vara wrote that the doors of bankruptcy courts are “open to honest, but naive debtors.” These doors “are not accessible to those that lack a legitimate bankruptcy goal or who seek to abuse the bankruptcy process to delay or hinder their creditors,” Vara continued.

On the other hand, J&J maintains there is no proof conclusive that their talc products, including its famous baby powder, can cause cancer. J&J has taken its products off from the market and will first launch them to be available in North America in 2020–and the remainder of the globe later this year.

J&J intends to steer clear of the expense of going to court. The company has won the majority of the cases that were decided at trial, but some losses have been severe.
A highly-publicized trial in Missouri produced an $4.7 billion judgment against the drug manufacturer but was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine cases involving talc, which are in appeal or concluded. Out of 41 trials, 32 have ended in an outcome for J&J either through a mistrial or verdict of a plaintiff annulled upon appeal. Talc is it safe. The company also has announced plans to settle nearly 1000 cases at a cost of 100 million dollars, Bloomberg announced at that time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Talc Is It Safe

June 2 2023 Update: During the trial for asbestos-containing talc that took place in California yesterday, a few technical issues disrupted the opening speech of defense attorneys. Talc is it safe. Jurors at home via Zoom however, heard Johnson & Johnson’s lawyer voice his doubt about the 70s research claiming asbestos was present in their product prior to the trial was abruptly closed.

In the meantime, the plaintiff was able to present its first expert witness Arthur Langer. Langer stated that the presence of additional minerals along with the talc’s mineral content is inevitable. He also testified that his team had notified J&J in the year 1971 of the presence of chrysotile asbestos the company’s talc, albeit with lower than 0.1 percent. He also uncovered more asbestos in the year 1976.

June 1, 2023 Update: Talc is it safe. This is the first court trial that has taken place since J&J took the decision to disband its talc section and declaring bankruptcy is an important turning point in the ongoing talc litigation saga. Trial began yesterday in the poignant case of a young 24-year-old plaintiff, diagnosed with an extremely rare and aggressive form of mesothelioma last year. a diagnosis lawyers on both sides believe is a grave tragedy.

Opening statements laid bare huge differences between the sides’ story. The attorney representing the plaintiff aimed his ire against Johnson & Johnson, alleging the use of deceitful methods in their research practices as well as throughout the litigation procedure. According to the attorney, the company attempted to manipulate the definition of asbestos in spite of internal documents from the year 1978 and 1994 indicating that asbestos fibers that were found in the tissue of the plaintiff are included.

Johnson &J’s tangled $8.9 billion settlement proposal hangs in the balance with the progression of this trial. Despite the distinctive nature of this mesothelioma lawsuit and its distinctive issues in comparison to most talcum powder lawsuits A verdict in favor of the plaintiff could result in an unintended setback to Johnson & J’s hope of gaining broad acceptance for their proposed settlement among plaintiffs.

May 31st, 2023: Update from Johnson and Johnson’s bankrupted talc unit has is defending it’s second Chapter 11 filing in the in the face of challenges from the talc injury plaintiffs. In a written objection to the New Jersey bankruptcy court, the company argued that the filing differed fundamentally from the previous filing. The subsidiary emphasized the record-breaking commitment to $8.9 billion in settlement from J&J as the biggest settlement ever to be made in a mass tort bankruptcy case. Talc is it safe. There was no mention of how the magnitude of the settlement implies that it is a fair settlement. J&J also claimed support from various plaintiffs’ law firms representing over the 60,000 plaintiffs. This is not easy to confirm but it’s likely to be false.

May 24 2023 Update: Following Johnson & Johnson’s 2021 bankruptcy filing, the first trial concerning its cosmetic talc products allegedly with asbestos content is scheduled to start jury selection on Monday in California with Alameda County Superior Court, the most favored location for plaintiffs. Plaintiff claims that mesothelioma resulted from asbestos exposure from J&J’s products, an allegation that the company denies. The trial also involves six retailers who are accused of selling talc-containing products.

May 22nd, 2023 Update: Lawyers involved in the second J&J Talc bankruptcy are currently in a dispute over who should be chosen to fill the post of the claims representative in the future, which is vitally critical to resolving Talc claims. Talc is it safe. Randi Ellis, a lawyer who frequently appears in MDLs throughout the United States was appointed as the claims representative in the initial bankruptcy. J&J’s defense team wants Ellis to be appointed in that position in the future, however lawyers representing the talc plaintiffs have raised objections to the claim that Ellis has an unrelated conflict of interest that should prevent her from being appointed to that post in the future. The issue stems from the fact that Ellis was reportedly involved in drafting the controversially disputable second bankruptcy, which raises concerns regarding her capacity to remain neutral. However, the reality is that this bankruptcy is likely to be dismissed in the end.

May 17th, 2023 Update: The fake company J&J created for the talc litigation bankruptcy has informed the New Jersey bankruptcy court that they have designated $400 million to settle claims made by states accusing the company of misleading advertising for its talc products. Talc is it safe. So that makes it an $8.5 billion settlement for cancer victims. It’s difficult to imagine a scenario where J&J can get these settlements for babies given these numbers. While J&J’s $8.5 billion offer sounds like a large sum initially, it may not look good when you look at the numbers. The proposed settlement based on our rough calculations, would not offer victims anything more than a median settlement of $100,000 per case. It’s not enough.

May 15th 2023 Update: J&J could be facing lawsuit from an advocacy group representing cancer patients. Talc is it safe. The group contends that J&J intentionally canceled the $61.5 billion contract for funding with its subsidiary, LTL Management LLC, to simulate financial distress and confirm the unit’s Chapter 11 bankruptcy filing. The group asserts this action could be interpreted as a fraudulent transfer of right to compensation for victims. They intend to investigate J&J’s actions after the announcement of the denial of the first bankruptcy case of LTL.

May 10, 2023 Update: Next week in the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to reject the second bankruptcy filing of J&J LTL Management, J&J’s subsidiary. LTL Management. In the meantime, however this bankruptcy court has issued an Order that requires both parties to take part in a settlement mediation to see if a global settlement deal can reached.

May 5, 2023 Update: Talc producer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to many lawsuits claiming that its talc products cause cancer due to asbestos exposure. Talc is it safe. Over 2700 people have sued the company and the company was paying $1 million per month on legal defense. The company’s recent $29million verdict on the state of South Carolina forced it to apply for bankruptcy protection and argue for a fair distribution of assets between talc claimants rather than being seized through the receiver. Other suppliers of talc have declared bankruptcy because of litigation.

May 4 2023 update: U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to restart talks with lawyers who rejected the proposed $8.9 billion deal. In Trenton, New Jersey yesterday, the parties appeared before a judge to discuss the next steps to take in another bankruptcy proceeding and Judge Kaplan was pushing for more settlement discussions.

This is the solution to settle these claims for J&J. A baby powder settlement could be achieved. Talc is it safe. But it’ll need additional money – perhaps billions of dollars coming from Johnson & Johnson.

Lawyers are split on whether to take the proposal or not and not all clients see the situation the same way their lawyer does. Second bankruptcy cases are destined to fail and Judge Kaplan has scheduled a hearing for June to decide if he will remove the bankruptcy after the second.

May 3, 2023 Update The group of cancer victims suing Johnson & Johnson (J&J) demanded that J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation surrounding talc-based products. The group representing the claimants has filed a motion this week asking to the Third Circuit to consider their appeal and return the case the lower court with instructions to discharge the bankruptcy. Talc is it safe. They also asked that the halted tort litigation against J&J continue to continue.
LTL applied for Chapter 11 protection once again after its bankruptcy filing was denied by the Third Circuit earlier this year, offering an $8.9 billion payment. The committee believes that the recent ruling, which allows LTL’s 2nd Chapter 11 to continue, while also halting trials against J&J and J&J, requires immediate Third Circuit review. The US Trustee has also requested the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a response to the appeals court declaring the filing an “desperate and legally inadequate effort” by a small number of law firms with different financial interests.
May 1 2023 Update: One frequently asked question is how could the plaintiffs’ lawyers and their clients turn down $8.9 billion. Of course, that is an enormous amount of money. However, there are lots of victims. Talc is it safe. These are actually a good claims for plaintiffs. We have been reminded of this recently with two talc trials ended in large verdicts for the plaintiffs. In February the mesothelioma case involving talcum powder trial in Oregon led to a verdict worth $18.1 million. In the same month, a different mesothelioma talc case was brought to hearing on the other side of South Carolina and resulted in an award of $29 million for the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. which is one of the most prominent suppliers of talc within the U.S.
April 30 2023 Update: When J&J first attempted to drag the talcum powder lawsuit into bankruptcy, it did so with an offer to reserve $2 billion to settle the case. The sum was ridiculously low. All of the talc plaintiffs agreed with the offer. This time around, however, J&J has increased the offer to $8.9 If the talc plaintiffs will allow a bankruptcy settlement and they also have the support of a large segment of the talc plaintiffs and their attorneys. Talc is it safe. But with 75% of plaintiffs who are a talc, which is required to approve bankruptcy plans is not an easy task with so many lawyers with massive collections of baby powder lawsuits that are opposed in favor of the deal.

What is the solution to this impasse? More billions.
April 25 2023 Update: Talc patients have demanded a judge dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially distressed. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Talc is it safe. It was the 3rd Circuit dismissed its first Chapter 11 case in January, saying the company was not eligible for bankruptcy relief since it had not demonstrated financial difficulties.

The plaintiffs argue that LTL’s 2nd Chapter 11 case is an abuse of the bankruptcy system and that it’s being conducted in bad good faith. J&J says the bankruptcy settlement receives “significant support” from the firms that represent about 60,000 potential claimants. It is fair to say that lawyers representing plaintiffs and victims ‘ lawyers are not united over this $8.9 billion amount of settlement offered.

April 21st, 2023 Update A bankruptcy judge has decided that Johnson & Johnson must face new lawsuits alleging that the firm sold a baby powder that contained a chemical that causes cancer. Even though trials for the lawsuits involving talc are delayed for a minimum of 60 days and new lawsuits are able to be filed, and lawyers are able to begin preparing their cases. Talc is it safe. The judge expressed skepticism over J&J’s pathetic attempt to revive its strategy by filing a second bankruptcy trial.

April 13 2023 Update: biggest update is about the $8.9 billion over the course of 25 years settlement offer. Lawyers representing cancer patients within the MDL class action have vowed to fight the settlement alongside the talc claimants. Why? They argue that it’s not enough for 70,000 victims who have cancer. Talc is it safe. They argue that J&J should negotiate a bigger settlement or settle individual claims if the most recent bankruptcy is declared unconstitutional.

There is a different lawyer group that isn’t part of the top leadership in that class action. These lawyers have collectively amassed many thousands of cases. This group wants to settle today with what they believe is less than these victims deserve. The argument they make is two-fold. First, they argue that the settlement – about 100,000 dollars per plaintiff – is fair.

This argument isn’t easy to prove. However, their second argument has more teeth: victims can now not wait and they want their money now.

April 12 2023 Update: Many are wondering if J&J can file for bankruptcy again. The answer is complex and convoluted. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future lawsuits involving talc conclusively. It believes that it will be less expensive should there be a bankruptcy element that creates pressure to negotiate a settlement. Talc is it safe. In a quest to cover the 400-year span of American history, the company argues that bankruptcy benefits everyone by dispersing settlement payments more evenly and more efficiently than trial courts where litigants are awarded significant payouts, while others are left with nothing.

The basic tenet of the 3rd Circuit decision was this is not a case – an enterprise that is profitable, forming an affiliate to accept the legal risk and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. However, it also stated it was not financially difficulty due to the fact that J&J assured it of unlimited funding.
Then J&J did not hesitate to take advantage of the unlimited funding part of the holding and didn’t make any promises to provide unlimited funding for cases. The company says that its modified financing arrangements with its subsidiary address concerns of the appellate court, while offering claim payment funds. It’s as if giving victims lower amounts of money would resolve the overall issue.

Lawyers representing cancer victims who do not agree with the agreement counter this with what you conclude is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the biggest “fraudulent deal that has occurred in United States history.”

In spite of the legal jargon, J&J does not really think that the bankruptcy will endure. But it’s a way of pushing this $8.9 billion settlement through and maintain the pressure on plaintiffs.

April 10, 2023 Update: Bloomberg provides an insightful article about a new law within New Jersey that is shedding new light on the funding of litigation in the baby powder class action lawsuit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) over talc products in exchange for a share of any winnings. J&J is now offering the payment of $8.9 billion to settle all lawsuits.

The involvement of the funders is made public because of the New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rule aims to address the rising calls for regulation of the litigation funders. J&J has more than 60,000 claims when you include federal and state infant powder litigation. Third-party funding in mass tort claims has its pros and cons. But there is no question that we are seeing how third-party funding could level the playing field between people and big corporations in court.

April 4, 2023 Update: It’s interesting to watch the worm turn in this case. J&J suffered another setback this week when an appeals court in the Third Circuit denied J&J’s request to continue the automatic stay while J&J appeals an appeal in the U.S. Supreme Court. Automatic stays have froze hundreds of cases involving talcum powder and stopped new lawsuits from getting filed ever since J&J began the controversial plan to spin the talc liability into a bankrupt entity over one year back. Talc is it safe. After the 3rd Circuit ruled that this bankruptcy was not legal some months ago, the stay was removed. J&J was hoping to have it remain in effect until the SCOTUS appeal. The answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that is that the Supreme Court is willing even to take up the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay fully lifted, the first new cases have been filed and transferred into the Talcum Powder class action MDL within a year. Seven new talc-related lawsuits were included in the MDL over the last month which brings the total number of pending cases up to 37,522.

February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now demanding that The U.S. Government Accountability Office (GAO) launch an investigation into the cost J&J Talc products have cost the government in the years.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the risks of its talc product for years while tax dollars were utilized to treat people injured by exposure to the chemicals. The suit comes just a few days after J&J’s major loss in the 3rd Circuit Court of Appeals.

Talc is it safe. J&J must begin making reasonable settlement offers to victims to the process of putting all this behind it. It is a stain on one of the greatest companies.

February 14 2023 Update: In a hearing today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
