While J&J’s $8.5 billion offer sounds like a lot of money initially, it does not look great when you consider the math. May 3, 2023 Update The group of cancer victims suing Johnson & Johnson (J&J) demanded an order from J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block the litigation involving talc products. The group of talc claimants has filed a motion this week, asking that the Third Circuit to consider their case and then send it back an earlier court, with instructions to dismiss the bankruptcy. The US Trustee requested an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation, Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a response in the appeals court declaring the filing a “desperate and legally flawed attempt” by a select group of law firms with competing financial interests.
May 1, 2023 Update: One common question that people ask is how could the plaintiffs’ lawyers and their clients turn on $8.9 billion. Of course, that is an enormous amount of money. But there are plenty of victims. Talc powder for men bad. And these are really good arguments for plaintiffs. We have been reminded of this recently in two talc trials which ended in large verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon was settled with an award worth $18.1 million. A month later, another mesothelioma-related talc case went to hearing at South Carolina and resulted in an award of $29 million in favor of plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc., one of the most prominent producers of talc in the U.S.
April 30, 2023 Update: When J&J initially attempted to pull the litigation over talcum powder into bankruptcy, they came with an offer to set aside $2 billion for settlements. This was an absurdly low amount. All of the talc plaintiffs supported the offer. Talc powder for men bad. But with 75% of plaintiffs of talc are required for bankruptcy plan approval is not an easy task due to the sheer number of lawyers with large stocks of baby powder litigations opposed in favor of the deal.
What are the solutions to the impasse? More billions.
April 25, 2023 Update Talc patients have sought a court order to disqualify the Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, which claims that the business is not financially strained. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Talc powder for men bad. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January, saying LTL was not a candidate for bankruptcy relief because it failed to show financial trouble.
The claimants argue that the 2nd Chapter 11 case is an abuse of the bankruptcy system and it is being pursued in bad good faith. J&J states that the bankruptcy settlement has “significant support” from companies representing approximately 60,000 claimants. It’s safe to say that plaintiffs’ lawyers and victims are divided over their disagreement over the $8.9 billion settlement offer.
April 21st, 2023 Update A bankruptcy judge decided the company Johnson & Johnson must face new lawsuits alleging that it sold tainted baby powder causing cancer. Even though trials for talc lawsuits are paused for at least 60 days but new lawsuits can be filed, and lawyers may begin to prepare their cases. Talc powder for men bad. The judge expressed skepticism over J&J’s absurd attempt to revive its plan with a second bankruptcy trial.
April 13th, 2023 Update: The most important news is the $8.9 billion over the next 25 years settlement offer. Lawyers representing cancer patients in the MDL Class Action have promised to fight the settlement with the talc claimants. Why? They think it is not enough for those suffering from cancer who are 70,000. Talc powder for men bad. They argue that J&J should seek a bigger settlement or settle individual claims if the most recent bankruptcy is dismissed.
There is a different lawyer group that isn’t part of the leadership group in group action. These lawyers have collectively amassed hundreds of thousands of cases. This group wants to settle today for what many argue is far less than what these victims deserve. Their argument appears to be two-fold. First, they argue that the settlement, which is about 100 million dollars on average per plaintiff is fair.
This argument isn’t easy to present. But their second argument has more substance: the victims will now not wait and they want their money now.
April 12 2023 Update: Many are asking how J&J is able to file for bankruptcy once more. The answer is complicated and complex. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc litigations in a definitive manner. It believes it can pay less if there is a bankruptcy component that applies pressure for a settlement. Talc powder for men bad. Moving past hundreds of years of American past, the company asserts that bankruptcy benefits all parties by distributing settlements more fairly and more efficiently than trial courts in which some litigants receive substantial payouts, while others are left with nothing.
The essence of the 3rd Circuit decision was this is not a case of one that makes a profit, but a subsidiary to take the legal responsibility and declare bankruptcy Congress contemplated when drafting the Bankruptcy Code. However, the court also ruled that the subsidiary was not in financial distress due to the fact that J&J offered unlimited financing.
This is why J&J decided to go with the unlimited funding aspect of the contract and didn’t promise that it would provide unlimited funds for the litigation. J&J claims that its new financing agreements with its subsidiary address the concerns of the appeals court while offering funds to pay claims. As if offering victims less money will solve the overarching problem.
Attorneys representing cancer victims who are against the agreement argue the agreement with what is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole is not exempt: victims’ lawyers call this the biggest “fraudulent move ever in United States history.”
Despite the legal jargon, J&J does not really think this bankruptcy will survive. But it is a way to push for this $8.9 billion settlement and keep the pressure on plaintiffs.
April 10 2023 Update: Bloomberg is running an intriguing article on a new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a portion of any profits. J&J is now offering the payment of $8.9 billion to settle all lawsuits.
The involvement of funders is publicly available because of an New Jersey court rule requiring the release of certain details regarding outside funding backers. The rules aim to address the rising calls for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you include federal and state Baby Powder lawsuits. Third-party funding for mass tort lawsuits has both pros and cons. But there is no question that we are witnessing how third-party funding can level the playing field between individuals and big corporations in court.
April 4 2023 Update: It is fun to watch the worm turn in this litigation. J&J suffered another setback this week when the Third Circuit denied J&J’s request to continue the automatic stay during the time that J&J appeals a bankruptcy ruling before the U.S. Supreme Court. It has frozen hundreds of cases involving talcum powder and stopped any new lawsuits from being filed ever since J&J initiated the controversial effort to spin the talc debts off into a bankrupt subsidiary over one year earlier. Talc powder for men bad. After the 3rd Circuit ruled that this bankruptcy was invalid just a few months ago the stay was removed. J&J was hoping to have it stayed in place until hearing the SCOTUS appeal. But the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that of the Supreme Court is willing even to hear the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay having been in effect, the first new cases have been filed and transferred into the talcum powder class action MDL in just over a year. Seven new talc lawsuits were brought into the MDL in the past month which brings the total number of pending cases up to 37,522.
February 25 2023 Update: A Congressmen from Tennessee is now requesting that authorities from the U.S. Government Accountability Office (GAO) start an investigation into the amount J&J talc products have cost the government in the years.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the dangers of its talc product for long while tax dollars spent on treating people who suffered injuries from exposure to the product. The suit comes just a few days after J&J’s major loss in the 3rd Circuit Court of Appeals.
Talc powder for men bad. J&J must begin making fair settlement offers to victims to getting this behind it. This is a blemish on one of the most prestigious businesses.
February 14 2023 Update: At an appearance today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
