Johnson & Johnson asserts that bankruptcy is the only method to address both present and future talc lawsuits conclusively. That is, it believes it can pay less if there is an element of bankruptcy that puts pressure for a settlement. Talc safe for pregnancy. Moving past more than 400 years in American history, the company asserts that bankruptcy benefits everyone by dispersing settlement payments more equitably and effectively than trial courts, where litigants are awarded significant awards while others receive nothing.

Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. However, it’s a means of pushing this $8.9 billion settlement through and maintain pressure on plaintiffs.
