The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) over talc products in exchange for a percentage of any wins. J&J is now willing an offer of $8.9 billion to settle all lawsuits.
The involvement of funders is publicly available due to the New Jersey court rule requiring the release of certain details regarding outside funding backers. The rules aim to address the growing calls for regulation of the litigation funders. J&J is facing more than 60,000 claims when you combine federal and state infant powder litigation. Third-party funding in mass tort claims is not without its pros and cons. There is no doubt that we are seeing how third-party financing can help level the playing field between people and big companies in court.

J&J was hit again this week when an appeals court in the Third Circuit denied J&J’s request to continue the automatic stay in the meantime that J&J appeals an appeal to the U.S. Supreme Court.
