Talco Johnson peru. J&J has said that its Talc products are safe, and will not cause cancer. The company is trying for another time to settle more than 38,000 lawsuits in bankruptcy, and to prevent any new cases from arising in the near future.
LTL’s bankruptcy plans would deposit $400 million to a separate trust for claims brought from state attorney generals claiming that J&J was in violation of states’ unfair practices and consumer protection laws, by deceiving consumers regarding the quality of its talc products.
Several states had begun consumer protection measures against J&J prior to the time that LTL’s bankruptcy filing stopped those investigations from moving forward in 2021. Talco Johnson peru. New Mexico and Mississippi had already brought lawsuits with Johnson & Johnson before then as well as the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas according to court papers.
New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy in a joint move with cancer victims as well as the U.S. Justice Department’s watchdog on bankruptcy, who argue that a profit-making company such as J&J can’t benefit from bankruptcy protections meant for struggling debtors.
LTL’s first attempt at resolving the bankruptcy cases was dismissed after similar arguments. The U.S. appellate court decided it was not LTL did not have “financial difficulty” and ineligible to receive bankruptcy relief. Talco Johnson peru. LTL declared bankruptcy a second time in just two hours following that dismissal, arguing that its second attempt was different as it had less money and more support for an agreement.
New Mexico and Mississippi said in their motion to dismiss that LTL’s new bankruptcy violates the law enforcement powers of the state by attempting unilaterally to cap the liability of the company for state consumer protection measures.

LTL’s new filings also included more details on how the company would assess and settle cancer claims in the event that the bankruptcy plan is approved.

Judge gives order to J&J and talc oppositionists to engage in settlement talks.
Following another round of hearings in Johnson &Johnson’s attempt to employ a Texas Two Step bankruptcy strategy to settle talc lawsuits, federal bankruptcy Judge Michael Kaplan has ordered the firm and the people who opposed the move to conduct settlement talks, Bloomberg reports.
The second time it attempted to file for bankruptcy for LTL Management, a subsidiary created by J&J to handle the claims company made a settlement offer of $8.9 billion. Talco Johnson peru. While a group of law firms representing plaintiffs agree with the deal, another group opposes the move.
The previous week, the opposition group, which is known as the Official Committee of Talc Claimants and urging the bankruptcy court for dismissal of the matter by asserting that LTL is not considered to be in financial hardship.
“The filing is a desperate and legally deficient attempt by a few of law firms to try to stop claimants from deciding on the resolution plan–a plan the vast and growing majority of claimants approve of,” J&J’s litigation chief Erik Haas, said in a statement. Talco Johnson peru. “The law firms behind the filing are pursuing financial interests which clash with, diverge from and oppose the interests they represent. We’ll submit a response in the appeals court.”
Talco Johnson peru. Clay Thompson, a lawyer for MRHFM who boasts more than mesothelioma clients who have sued J&J and J&J, has said that the second bankruptcy attempt of J&J will fail.
“J&J issues press releases about how wonderful its plan is while simultaneously demanding that plan details–including what the individual sick individuals would receive — be kept private,” Thompson said in an email. “What does the company have to conceal?”
Kaplan has directed the parties to create a strategy for reorganization, under the supervision by two mediators.
In February 2022, Kaplan confirmed J&J’s use of Chapter 11 to hasten a settlement that would free the company from the thousands of lawsuits concerning its talcum products.
But in the month of January, a federal appeals court overturned the ruling, ruling that the firm could not be considered in “financial difficulty.”
When J&J’s attempt to contest the U.S. Supreme Court was rejected the same month, J&J applied for its first bankruptcy about two hours later. In response, Kaplan froze the lawsuits for 60 days in order to determine whether to allow the second bankruptcy.
J&J’s unstoppable profit machine sputters after $6.9B the talc litigation cost.
In the Two Chapter 11 attempts, J&J has purchased 19 months of which cases were put held. Talco Johnson peru. The company would like claimants to accept their settlement. J&J will require 75% support for the settlement to be approved.
In addition to the group of talc lawyers that criticized the company’s bankruptcy and the U.S. Trustee, an arm that is part of the U.S. Department of Justice has also filed an appeal to dismiss LTL’s bankruptcy second case.
In a statement this week, U.S. Trustee Andrew R. Vara wrote that the bankruptcy courts are “open to honest but unfortunate debtors.” Those doors “are not available to anyone that do not have a legitimate purpose or that seek to use the bankruptcy process to hinder or delay their creditors.” Vara continued.
To its credit, J&J maintains there is no definitive evidence to suggest that its Talc products, which includes its famous baby powder, cause cancer. J&J has taken its products off of the market–first on North America in 2020–and the rest of the world later this year.
J&J seeks to avoid the expense of going to trial. The company has won the majority of cases that have been decided during trial, however, certain losses have been extremely severe.
A highly-publicized trial in Missouri produced an $4.7 billion verdict against the drugmaker but was later reduced to $2.1 billion after appeals.
Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine trial cases in talc which are appealing or concluded. The plaintiff had the opportunity to present the first of their witnesses, Arthur Langer. Langer said that the presence of other minerals with the talc’s mineral content is inevitable. June 1st, 2023 Update Talco Johnson peru. This is the first court trial that has taken place since J&J decided to spin off its Talc section and declaring bankruptcy is an important turning point of the ongoing lawsuit saga. The trial began on Tuesday in the harrowing case of a young 24-year-old plaintiff who was diagnosed with an aggressive and rare form of mesothelioma last year. a diagnosis lawyers on both sides agree is a grave tragedy.
Opening statements revealed the sharp differences in the two sides’ narrative. The attorney representing the plaintiff aimed his ire against Johnson & Johnson, alleging the use of misleading techniques in its research practices and throughout the litigation process. According to the attorney, Johnson & Johnson tried to alter asbestos’ definition, despite internal documents from between 1978 and 1994 that showed asbestos fibers found in plaintiff’s tissue are included.
Johnson &J’s tangled $8.9 billion settlement proposal hangs in the balance with the course of this trial. Despite the unique nature of this mesothelioma case and its unique challenges compared to the majority of talcum powder lawsuits A verdict in favor of the plaintiff could be the company with a major setback in its hopes of broad acceptance of their proposed settlement with plaintiffs.
May 31st, 2023 Update: Johnson & Johnson’s bankrupt talc business strongly defended their 2nd Chapter 11 filing in the face of challenges from victims of talc injuries. In an opposition filed with the New Jersey bankruptcy court, J&J’s subsidiary claimed that the case differed fundamentally from the previous filing. It also emphasized the unprecedented commitment of $8.9 billion by J&J which is the biggest settlement ever to be made in any bankruptcy case that involves mass tort. Talco Johnson peru. The issue is not discussed: whether this amount means it is a fair settlement. J&J also claimed that it received support from a variety of plaintiffs’ law companies representing over sixty thousand claimants. This is hard to verify however it is likely to be incorrect.
May 24 2023 Update: Following Johnson & Johnson’s 2021 bankruptcy filing, the first trial on its cosmetic talc items allegedly containing asbestos is set to start jury selection on Monday in California at Alameda County Superior Court, which is a well-known place for plaintiffs. The plaintiff claims that his mesothelioma is the result of asbestos exposure from J&J’s products which that the company denies. The trial also includes six retailers accused of selling talc-containing products.
May 22nd, 2023 Update Lawyers involved in the second J&J talc bankruptcy are in a dispute over who should be appointed to the role of a future claims representative, an important role critical to resolving Talc claims. Talco Johnson peru. Randi Ellis, a lawyer who is frequently involved in MDLs throughout the country was appointed the claims representative in the first bankruptcy. J&J’s defense attorneys want Ellis to be appointed to this position yet again, but the lawyers for the plaintiffs in talc are arguing to the claim that Ellis has conflicts of interest which should stop her from taking on that role once more. The dispute stems from reality that Ellis was involved in drafting the hotly disputable second bankruptcy, which raises doubts about her capability to remain neutral. It’s true that the bankruptcy will be dismissed in the end.
May 17, 2023 Update The fake company J&J created to handle the bankruptcy of talc has informed a New Jersey bankruptcy court that they have designated $400 million to settle the claims of states that accuse J&J of misleading marketing regarding its talc products. Talco Johnson peru. It’s a $8.5 billion settlement to cancer victims. It is hard to imagine a scenario where J&J will be able to push these settlements for babies with these numbers. While J&J’s $8.5 billion offer sounds like a large sum initially, it will not appear appealing after you calculate the figures. This settlement offer based on our rough calculations – would not offer victims anything more than $100,000 per instance. It’s not enough.
May 15 2023 update: J&J might be facing suit from an advocacy group that represents cancer patients. Talco Johnson peru. The group contends that J&J deliberately retracted a $61.5 billion financing agreement that it had with its company subsidiary LTL Management LLC, to simulate financial stress and verify the unit’s Chapter 11 bankruptcy filing. The group claims that this move is a fraud transfer of rights of victims’ compensation. They will investigate J&J’s actions in the wake of the denial of LTL’s first bankruptcy suit.
May 10, 2023 Update: Next week this week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy petition filed of J&J subsidiaries LTL Management. In the meantime, however the bankruptcy has issued an order calling for both parties to participate in a second settlement mediation in the hope that a global settlement deal can come to fruition.
May 5th 2023 Update: Talc manufacturer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging that its Talc products cause cancer due to asbestos exposure. Talco Johnson peru. More than 2700 people have filed lawsuits against the firm, and it was paying $1 million per month to defend itself. The company’s most recent $29 million settlement in South Carolina forced it to apply for bankruptcy protection and argue that assets should be distributed in an equitable manner to talc claimants, rather than being taken over through the receiver. Other suppliers of talc have filed for bankruptcy due to litigation.
May 4 2023 Update: U.S. The bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to restart negotiations with lawyers who turned down the proposed $8.9 billion agreement. In Trenton, New Jersey yesterday, the parties appeared before a judge to discuss the next steps for the second bankruptcy case. Judge Kaplan has pushed for further settlement talks.
This is the best way to resolve these claims for J&J. A settlement for baby powder can be made. Talco Johnson peru. But it’ll need more money – billions of dollars coming from Johnson & Johnson.
Lawyers are split on whether to take the proposal or not and not every client sees the issue the same way their lawyer views it. This second case of bankruptcy is bound to go nowhere as Judge Kaplan has set a date for a hearing in June to determine whether to remove the bankruptcy after the second.
May 3, 2023 Update: A group of cancer patients who have sued Johnson & Johnson (J&J) demanded to have J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation involving talc products. The group representing claimants for talc filed a motion on Tuesday requesting to the Third Circuit to consider their case and to send it back an earlier court with instructions to dismiss the bankruptcy. Talco Johnson peru. They also asked that the lawsuit against the halted torts of J&J allow the litigation to proceed.
LTL requested Chapter 11 protection once again following the bankruptcy filing it made earlier was rejected by the Third Circuit earlier this year which offered a $8.9 billion deal. The committee says that the recent decision allowing LTL’s 2nd Chapter 11 to continue, as well as halting the trials against J&J should be subject to the immediate Third Circuit review. The US Trustee requested an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a formal response in the appeals court saying that the filing is an “desperate and legally inadequate effort” by a select group of law firms who have conflicting financial interests.
May 1 2023 Update: One question people keep asking is how could the plaintiffs’ lawyers and their clients turn down $8.9 billion. Of course, that’s quite a sum. But there are a lot of victims. Talco Johnson peru. They are a great cases for plaintiffs. We were reminded of this recently with two talc trials resulted in big verdicts for plaintiffs. In February, a talcum powder mesothelioma trial in Oregon was settled with the verdict in the amount of $18.1 million. A month later, another mesothelioma talc case was brought to trials within South Carolina and resulted in a verdict of $29 million for the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. one of the largest manufacturers of talc in U.S.
April 30 2023 Update: In the year 2023, when J&J initially tried to take the talcum powder litigation into bankruptcy, it came with an offer to set aside $2 billion to settle the case. This was an absurdly low amount. There was no one among the talc victims who believed in it. This time around, however, J&J has increased the offer to $8.9 If the talc plaintiffs are willing to accept bankruptcy settlements and they have the support of a large part of the talc-related plaintiffs and their lawyers. Talco Johnson peru. But 75% of the plaintiffs who are a talc, which is necessary for bankruptcy plan approval is not an easy task because of the number of lawyers who have massive inventory of baby powder litigations opposed to the settlement.
What are the solutions to the impasse? More billions.
April 25 2023 update: Talc patients have asked a judge to reject the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Talco Johnson peru. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible for bankruptcy relief since it was unable to demonstrate financial stress.
The claimants argue that LTL’s Second Chapter 11 case is an fraud on the bankruptcy system and it is being pursued in bad good faith. J&J claims the bankruptcy settlement is backed by “significant support” from firms representing approximately 60,000 plaintiffs. It is fair to say plaintiffs’ lawyers and victims are divided over the $8.9 billion deal.
April 21, 2023 Update: A bankruptcy judge has ruled in favor of Johnson & Johnson must face new lawsuits alleging that the company sold tainted baby powder causing cancer. Even though trials for talc lawsuits are paused for at least 60 days but new lawsuits can be filed and lawyers are able to begin preparing their cases. Talco Johnson peru. Judges expressed skepticism about J&J’s pathetic attempt to revive its plan with another bankruptcy case.
April 13th 2023 Update: major news is the $8.9 billion over the course of 25 year period settlement offered. Lawyers representing cancer patients who are part of MDL class action MDL class action have pledged to fight the settlement along with the talc claimants. Why? They argue that it’s too little money for the 70 000 cancer patients. Talco Johnson peru. The lawyers say that J&J should seek a bigger settlement or litigate individual claims in the event that the latest bankruptcy is declared unconstitutional.
But there is another group of lawyers outside of the top leadership in group action. They have amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle today for what many argue is lower than what the victims should be paid. Their argument is twofold. First, they argue the settlement of around an average of $100,000 per plaintiff – is fair.
It’s a difficult argument to prove. However, their second argument has more teeth: victims can be no longer patient and demand to get their money right now.
April 12 2023 Update: Many are wondering if J&J is able to file for bankruptcy once more. The answer is complicated and convoluted. But let’s try to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only way to address both present and future talc litigations in a definitive manner. Also, it believes that it will be less expensive in the event of a bankruptcy element that creates pressure to settle. Talco Johnson peru. Driving past 400 years of American history, the company argues that bankruptcy benefits all parties by distributing settlements more equally and efficiently than trial courts, in which some litigants receive substantial award while others do not.
The main thrust in the 3rd Circuit decision was this is not a case of an enterprise that is profitable, forming an affiliate to accept the legal burden and declare bankruptcy Congress had in mind when it came to drafting the Bankruptcy Code. However, it also stated the company was in financial crisis because J&J promises unlimited funding.
So J&J took advantage of the unlimited funding portion of the agreement and did not promise that it would provide unlimited funds for litigation. The company says that its updated financing arrangements with its subsidiary will address appeals court’s concerns while still providing funds for claims. As if providing victims with lesser money could solve the overall issue.
Lawyers representing cancer victims who oppose the deal counter this argument by saying that it is the legal argument. Talco Johnson peru. They counter with legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s decision. The hyperbole wasn’t spared: victims’ lawyers call it the largest “fraudulent move of assets in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. However, it’s a means of trying to push this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10, 2023 Update Bloomberg has an interesting report on a brand new law of New Jersey that is shedding new light on litigation funding in the baby powder plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) regarding talc products, in exchange for a percentage of any profits. J&J is now offering that it will pay $8.9 billion to settle lawsuits.
The funders’ involvement is publicly available due to a New Jersey court rule requiring the release of certain details about outside funding backers. The rules aim to address the rising calls for the regulation of lawsuit funders. J&J has more than 60,000 claims when you add up state and federal infant powder litigation. Third-party funding of mass tort cases has pros and pros and. There is no doubt that we are witnessing the ways that third-party funding can even the playing field between people and big corporations in court.
April 4, 2023 Update: It’s interesting to watch the worm turn in this case. J&J was hit again this week when an appeals court in the Third Circuit denied J&J’s request to extend the automatic stay during the time that J&J appeals a bankruptcy decision to the U.S. Supreme Court. It has halted hundreds of cases involving talcum powder and stopped any new lawsuits from getting filed ever since J&J launched the controversial attempt to spin the talc liability into a bankrupt subsidiary more than one year ago. Talco Johnson peru. After the 3rd Circuit ruled that this bankruptcy was invalid some months ago, the stay was removed. J&J wanted to see it continued pending its SCOTUS appeal. But the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that for the Supreme Court is willing even to consider the appeal? Low.
March 16 2023 Update: with the bankruptcy stay having been in effect, the first new cases were filed and incorporated into the class action for talcum powder MDL in just over a year. Seven new talc-related lawsuits were joined to the MDL in the past month, bringing the total number of pending cases up to 37,522.
February 25, 2023 Update 2023 Update: A Congressmen from Tennessee is now calling for The U.S. Government Accountability Office (GAO) initiate an investigation to determine how much J&J product containing talc has cost the government in the years.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the dangers of its talc product for years while tax dollars were spent on treating people who suffered injuries from exposure to the products. The lawsuit comes just a few weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Talco Johnson peru. J&J needs to start making fair settlement offers to victims to to put all of this behind it. It is a stain on one of the most prestigious businesses.
February 14 2023 Update: At the hearing held today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
