Kaplan has directed the parties to develop a new reorganization plan, under supervision by two mediators.
The court in February of 2022 Kaplan confirmed J&J’s recourse to Chapter 11 to hasten a settlement that would relieve the company from the thousands of lawsuits regarding its talcum products.

J&J’s global vice president of litigation Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a formal response to the appeals court declaring the filing a “desperate and legally insufficient attempt” by a few of law firms that have competing financial interests.

Talcum powder lawsuit cnn. However, 75% of plaintiffs in the talc category, which is required for bankruptcy plan approval is a difficult road due to the sheer number of lawyers with huge collections of baby powder lawsuits that are opposed towards the agreement.
What could solve the impasse? More billions.
April 25, 2023 update: Talc plaintiffs have demanded a judge dismiss their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Talcum powder lawsuit cnn. It was the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible for bankruptcy relief as it had not demonstrated financial stress.
The plaintiffs argue that LTL’s third Chapter 11 case is an overreach of the bankruptcy system and it is being pursued in bad faith. J&J says the bankruptcy settlement receives “significant support” from companies representing about 60,000 potential people who are claiming. It’s safe to say that plaintiffs’ lawyers and victims ‘ lawyers are divided on the $8.9 billion amount of settlement offered.
April 21st, 2023 Update: A bankruptcy judge ruled that Johnson & Johnson must face new lawsuits alleging that the firm sold tainted baby powder causing cancer. While trials in the talc lawsuits have been suspended for at least 60 days, new lawsuits can be filed and lawyers may begin to prepare their cases. Talcum powder lawsuit cnn. Judges expressed skepticism about J&J’s absurd attempt to revive its strategy with the second bankruptcy case.
April 13 2023 Update: most important story is that there’s an $8.9 billion over the course of 25 years settlement offer. Lawyers representing cancer patients in MDL class action MDL collective action pledged to fight the settlement along with Talc claimants. Why? They think it is not enough to pay for 70,000 victims who have cancer. Talcum powder lawsuit cnn. These lawyers believe that J&J should seek a bigger settlement or settle individual claims in the event that the latest bankruptcy is declared unconstitutional.
But there’s a separate group of lawyers outside of the leadership group in this class action. These lawyers have amassed many thousands of cases. They want to settle now for what is believed to be far less than what these victims deserve. Their argument seems to be two-fold. First, they argue the settlement – about 100,000 dollars per plaintiff – is fair.
It’s a difficult argument to prove. However, their second argument has more force: the victims can be no longer patient and demand their money today.
April 12 2023 Update: People are asking how J&J is able to file for bankruptcy once more. The answer is complex and complex. However, let’s attempt to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only means to address both present and future talc-related lawsuits definitively. In other words, it believes it can pay less if there is a bankruptcy element that creates pressure to settle. Talcum powder lawsuit cnn. Moving past more than 400 years in American history, the firm argues that bankruptcy benefits all parties by distributing settlements more fairly and effectively than trial courts, in which some litigants receive substantial award while others do not.
The gist of the 3rd Circuit decision was this is not a case – one that makes a profit, but an affiliate to accept the legal liability and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. However, the court also ruled it was not financially distress due to the fact that J&J offered unlimited financing.
This is why J&J did not hesitate to take advantage of the unlimited funding part of the contract and did not promise to offer unlimited funding for litigation. The company claims that updated financing arrangements with its subsidiary address appeals court’s concerns while still providing funds for claims. It’s as if giving victims less money would solve the problem at hand.
Attorneys representing cancer patients who are against the agreement argue this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole was not spared attorneys representing the victims claim this the biggest “fraudulent move ever in United States history.”
Despite the legal jargon, J&J does not really think that the bankruptcy will endure. It is however a method to try and push the $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10 2023 Update: Bloomberg is running an intriguing article about a new law that has been passed in New Jersey that is shedding new light on litigation funding in the suit for class actions. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) concerning talc products in exchange for a percentage of any profits. J&J has now offered that it will pay $8.9 billion to settle all lawsuits.
The involvement of the funders is publicly available due to a New Jersey court rule requiring the release of certain details about funders outside the state. The rule aims to respond to the increasing calls for regulation of litigation funders. J&J has more than 60,000 claims when you combine federal and state baby powder lawsuits. Third-party funding of mass tort cases is not without its pros and pros and. But there is no question that we are seeing how third-party financing can help level the playing field for individuals and big companies in court.
April 4, 2023 Update: It is fun to watch the worm turn in this legal battle. J&J took another hit this week, when it was found that the Third Circuit denied J&J’s request to maintain the automatic stay as J&J appeals a bankruptcy decision to the U.S. Supreme Court. This automatic stay frozen hundreds of cases involving talcum powder and prevented new lawsuits from arising ever since J&J initiated the controversial effort to spin the talc liability off into a bankrupt subsidiary over a year earlier. Talcum powder lawsuit cnn. When it was decided that the 3rd Circuit ruled that this bankruptcy was not legal only a few months back, the stay was revoked. J&J wanted to see it continue in the meantime of hearing the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that for the Supreme Court is willing even to accept the appeal? Low.
March 16 2023 Update: with the bankruptcy stay now fully lifted, the first new cases have been filed and transferred into the talcum powder class action MDL in the space of a year. Seven new talc cases were added to the MDL during the month of March increasing the number of cases that are pending to 37,522.
February 25 2023 Update: A Congressmen from Tennessee is now demanding that authorities from the U.S. Government Accountability Office (GAO) start an investigation into the cost J&J talc products have cost the government in the many years.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the dangers of its talc products over decades while tax dollars were spent treating those injured by exposure to the product. The demand comes just weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
Talcum powder lawsuit cnn. J&J should begin to make reasonable settlement proposals to victims to begin the process of putting all this behind. This is a disgrace to one of the top companies.
February 14 , 2023 Update: At an earlier hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
