J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company will pay various types of cancer patients in an arrangement for bankruptcy. LTL’s bankruptcy plan will pay $400 million to an additional trust to settle claims made by state attorneys general claiming that J&J did not comply with laws against unfair business practices in the State of New York as well as consumer protection laws by misleading consumers about the safety of its talc products.

Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future talc lawsuits conclusively. Hyperbole is not exempt by the victims’ lawyers, who call this the biggest “fraudulent deal ever in United States history.”
Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. However, it’s a means of trying to push this $8.9 billion settlement to keep pressure on plaintiffs.

The involvement of funders is public information because of an New Jersey court rule requiring the release of certain details about funders outside the state.
