Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future talc-related lawsuits definitively. In other words, it thinks it can get a lower rate when there is an element of bankruptcy that puts pressure to negotiate a settlement. Hyperbole is not exempt by the victims’ lawyers, who call this the biggest “fraudulent move of assets in United States history.”

Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. But it’s a way of pushing this $8.9 billion settlement to keep the pressure on plaintiffs.
