Which talc is safe. April 25 2023, Update Talc Cancer victims have sought a court order to dismiss the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, saying the company is not financially troubled. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company wasn’t eligible for bankruptcy relief because it failed to show financial distress.
The claimants assert that LTL’s second Chapter 11 case is an fraud on the bankruptcy system and that it is being pursued in bad good faith. It’s fair to say plaintiffs’ lawyers and victims ‘ lawyers are divided on the $8.9 billion amount of settlement offered.
April 21st, 2023 Update: A bankruptcy judge has ruled the company Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. April 13, 2023 Update: The big update is about the $8.9 billion over the next 25 years settlement offer. Lawyers representing cancer patients in the MDL Class Action have promised to fight the settlement alongside Talc claimants. Why? They believe it’s not enough money for more than 70,000 cancer victims. Which talc is safe. The lawyers say that J&J could negotiate a greater settlement or even litigate individual claims in the event that the latest bankruptcy is thrown out.
There is a different group of lawyers that is not part of the leadership in group action. The lawyers collectively have accumulated hundreds of thousands of cases. They want to settle for what is believed to be lower than what the victims should be paid. The argument they make is two-fold. They argue that the settlement of around 100 million dollars on average per plaintiff – is fair.
It’s a difficult argument to present. But their second argument has more substance: the victims will not afford to wait any longer and need their money today.
April 12 2023 Update: People are seeking out how J&J is able to file for bankruptcy once more. The answer is complicated and confusing. However, let’s attempt to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future talc-related lawsuits definitively. That is, it thinks it will pay less when there is the bankruptcy element which applies pressure for a settlement. Which talc is safe. Moving past 400 years of American past, the company believes that bankruptcy is beneficial to everyone by dispersing settlement payments more equitably and efficiently than trial courts, in which some litigants receive substantial award while others do not.
The basic tenet in this 3rd Circuit decision was this is not a case of the profit-making company that has an affiliate to accept the legal burden and declare bankruptcy – Congress considered when it was drafting the Bankruptcy Code. However, it also stated the company was financially difficulty because J&J offered unlimited financing.
Thus, J&J jumped on the unlimited funding portion of the contract and didn’t make any promises to provide unlimited funding for the litigation. The company claims that new financing agreements with its subsidiary addresses the concerns of the appellate court, while offering claim payment funds. As if providing victims with less money would solve the problem at hand.
Lawyers representing cancer patients who do not agree with the agreement counter the agreement with what is the legal argument. Which talc is safe. They counter with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier decision. The hyperbole wasn’t spared by the victims’ lawyers, who call this the biggest “fraudulent move ever in United States history.”
Despite all the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way of pushing this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10, 2023 update: Bloomberg provides an insightful piece on a law that has been passed of New Jersey that is shedding new light on litigation funding in the class action lawsuit. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims in the case of Johnson & Johnson (J&J) concerning talc products in exchange for a portion of any profits. J&J has now offered an offer of $8.9 billion to settle lawsuits.
The involvement of the funders is publicly available because of an New Jersey court rule requiring the disclosure of certain information about funders outside the state. This rule is intended to tackle the growing demands for the regulation of litigation funders. J&J faces over 60,000 claims when you take into account state and federal baby powder lawsuits. Third-party funding for mass tort lawsuits has both pros and cons. There is no doubt that we are witnessing how third-party financing can help level the playing field for individuals and large corporations in court.
April 4 2023 Update: It is pleasing to see the worm turn in this lawsuit. J&J took another hit this week, when it was found that the Third Circuit denied J&J’s request to continue the automatic stay as J&J appeals an order granting bankruptcy to the U.S. Supreme Court. This automatic stay frozen the cases of talcum powder in a number of years and stopped new lawsuits from being filed ever since J&J initiated the controversial effort to spin the talc liabilities into a bankrupt subsidiary more than one year earlier. Which talc is safe. When it was decided that the 3rd Circuit ruled that this bankruptcy was invalid only a few months back, the stay was lifted. J&J was hoping to have it stayed in place until an appeal to the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that of the Supreme Court is willing even to take up the appeal? Low.

Seven new talc cases were joined to the MDL during the month of March, bringing the total number of cases that are pending to 37,522.
February 25, 2023 Update 2023 Update: A Congressmen from Tennessee is now calling for authorities from the U.S. Government Accountability Office (GAO) start an investigation into the cost J&J Talc products have cost the government over the years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the risks of its talc products for decades while tax dollars were used to treat those who were injured through exposure to the chemicals. The lawsuit comes just a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
Which talc is safe. J&J should begin to make reasonable settlement offers to victims to getting this behind. It is a stain on one of the most prestigious companies.
February 14 2023 Update: In the hearing held today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
