LTL filed for Chapter 11 protection once again following its bankruptcy filing that was rejected in the Third Circuit earlier this year which offered a $8.9 billion deal. The US Trustee has also requested it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s worldwide vice president of litigation Erik Haas, was quoted by Bloomberg as saying that J&J plans to file a response in the appeals court, declaring the filing a “desperate and legally deficient plan” by a small number of law firms who have conflicting financial interests.
May 1st 2023 Update: A common question that people ask is how plaintiffs and their attorneys turn on $8.9 billion. Of course, that’s an enormous amount of money. But there are a lot of victims. Has anyone received money from talcum powder lawsuit. They are a great cases for plaintiffs. We were reminded recently when two talc cases have resulted in huge verdicts for plaintiffs. April 30th 2023 Update: J&J initially attempted to pull the talcum powder lawsuit into bankruptcy, they came with an offer to put aside $2 billion to settle the case. This was an absurdly low amount. This time around, however, J&J has increased the offer to $8.9 if the talc plaintiffs agree to a bankruptcy settlement and they also have the support of a large part of the talc-related plaintiffs and their lawyers. Has anyone received money from talcum powder lawsuit. But with 75% of plaintiffs in the talc category, which is needed for approval of the bankruptcy plan is not an easy task with so many lawyers with huge inventories of baby powder litigations opposed towards the agreement.
What can be done to end the impasse? More billions.
April 25, 2023, Update Talc plaintiffs have asked a judge to disqualify their Chapter 11 case filed by LTL Management LLC, a absurdly made-up Johnson & Johnson subsidiary, saying the company is not financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Has anyone received money from talcum powder lawsuit. The 3rd Circuit dismissed its first Chapter 11 case in January and said that LTL was not eligible for bankruptcy relief as it had not demonstrated financial difficulties.
The plaintiffs argue that LTL’s Second Chapter 11 case is an overreach of the bankruptcy system and the case is being handled in bad faith. J&J states that the bankruptcy settlement has “significant backing” from the firms that represent approximately 60,000 plaintiffs. It’s safe to say that lawyers representing plaintiffs and victims ‘ lawyers are not united over the $8.9 billion deal.
April 21st, 2023 Update: A bankruptcy judge has decided the company Johnson & Johnson must face new lawsuits alleging that it sold baby powder that was contaminated and causing cancer. April 13, 2023 Update: The big announcement is an $8.9 billion over the course of 25 years settlement offer. Lawyers representing cancer patients in MDL class action MDL group action promised to fight the settlement alongside talc claimants. Why? They think it is not enough money for 70,000 victims who have cancer. Has anyone received money from talcum powder lawsuit. The lawyers say that J&J should negotiate a bigger settlement or even litigate individual claims if the most recent bankruptcy is thrown out.
There is a different set of lawyers who are not part of the leadership group in group action. They have amassed many thousands of cases. This group wants to settle for what is believed to be far less than what these victims deserve. Their argument is two-fold. First, they argue the settlement of around 100 million dollars on average per plaintiff – is fair.
That is a hard argument to present. However, their second argument has more substance: the victims will now not wait and they want to get their money right now.
April 12, 2023 Update: People are looking for ways J&J can go through bankruptcy again. The answer is complex and complicated. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc lawsuits conclusively. That is, it thinks it will pay less should there be a bankruptcy element that creates pressure for a settlement. Has anyone received money from talcum powder lawsuit. Going back to more than 400 years in American history, the firm argues that bankruptcy benefits all parties by distributing settlement payments more evenly and efficiently than trial courts, which are where litigants get significant payouts, while others are left with nothing.
The essence in the 3rd Circuit decision was this is not a case – a profitable company making an affiliate to accept the legal burden and declare bankruptcy, which is what Congress had in mind when it came to drafting the Bankruptcy Code. However, it also stated that the subsidiary was not in financial difficulty due to the fact that J&J promised unlimited funding.
Then J&J took advantage of the funding unlimited part of the contract and didn’t promise to fund unlimited litigation. The company claims that updated financing arrangements with its subsidiary will address concerns of the appeals court while offering funds to pay claims. As if providing victims with less money would solve the overall issue.
Attorneys representing cancer victims who do not agree with the agreement counter this with what you conclude is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole did not go unnoticed the lawyers representing victims call this the biggest “fraudulent transfer that has occurred in United States history.”
Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method of trying to push this $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10 2023, Update Bloomberg is running an intriguing piece on a law that has been passed in New Jersey that is shedding new light on litigation funding in the suit for class actions. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) regarding talc products, in exchange for a share of any profits. J&J is now willing an offer of $8.9 billion to settle all lawsuits.
The funders’ involvement is public knowledge because of a New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rule aims to respond to the increasing calls for regulation of the litigation funders. J&J is facing more than 60,000 claims when you include state and federal child powder-related lawsuits. Third-party financing in mass tort cases is not without its pros and cons. However, there is no doubt that we are witnessing how third-party funding could level the playing field between people and big corporations in court.
April 4 2023 Update: It’s pleasing to see the worm turning in this litigation. J&J suffered another setback this week, when it was found that the Third Circuit denied J&J’s request to maintain the automatic stay as J&J appeals a bankruptcy decision at the U.S. Supreme Court. It has halted thousands of talcum powder cases and prevented new lawsuits from being filed ever since J&J launched the controversial attempt to spin the talc liabilities into a bankrupt subsidiary more than one year in the past. Has anyone received money from talcum powder lawsuit. When it was decided that the 3rd Circuit ruled that this bankruptcy was not valid only a few months back, the stay was lifted. J&J wanted to see it continue in the meantime of its SCOTUS appeal. But the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance the Supreme Court is willing even to accept the appeal? Low.
March 16, 2023 Update: with the bankruptcy stay being fully lifted, the first new cases were filed and incorporated into the Talcum Powder class action MDL in just over a year. Seven new talc cases were included in the MDL during the month of March which brings the total number of cases that are pending to 37,522.
February 25 2023 Update The following information is available: A Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) start an investigation into the cost J&J product containing talc has cost the government over the many years.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the dangers of its talc-based products for decades while tax dollars were used to treat those who were injured through exposure to the chemicals. The demand comes just weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
Has anyone received money from talcum powder lawsuit. J&J has to begin making reasonable settlement proposals to victims, in order the process of putting all this behind it. This is a disgrace to one of the top companies.
February 14 2023 Update: At the hearing held today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
