Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future lawsuits involving talc conclusively. Hyperbole is not exempt by the victims’ lawyers, who call it the biggest “fraudulent transfer in United States history.”
Despite the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way to push for this $8.9 billion settlement through and maintain the pressure on plaintiffs.
